Terms & Conditions

1. Commission Structure

• Our listing commission is 1.5% of the final sales price of the property.

• A buyer’s agent commission (typically 1.5%) is customarily offered, bringing the total commission to approximately 3%.

• Commission percentages are negotiable by law in California and are always subject to the terms of a written listing agreement.

• A minimum listing fee may apply based on property value.

2. Services Included

Our 1.5% listing commission program includes full-service real estate marketing and representation. Services may include, but are not limited to:

• Professional home staging

• High-quality photography and videography

• 3D Matterport tours

• Drone footage (where applicable)

• Custom property websites and digital marketing

• Social media and online advertising

• MLS listing and syndication

• Offer management and negotiation

• Transaction coordination through closing

Specific services may vary by property and will be outlined in your Listing Agreement.

3. Additional Program Disclosures

To ensure transparency, the following disclosures apply to specific programs we offer:

• Free Staging & More – Complimentary staging and marketing services are included for full-service listings. Availability may vary by property, and certain conditions may apply.

• Renovate Now, Pay Later – Program availability may vary based on vendor approval. Renovation costs are deferred and collected at the close of escrow, with no upfront out-of-pocket expense.

• Maximize Your Home Value – Strategies to increase property value are tailored to each home. Results depend on market conditions and buyer demand, and cannot be guaranteed.

4. Exclusions and Limitations

• Some optional services may incur additional costs, which will be discussed and agreed upon in writing before being provided.

• Complimentary services (such as staging or photography) are offered at our discretion and may vary depending on the property.

• Services are subject to availability and vendor scheduling.

5. No Guarantees

• While we strive to help sellers achieve the highest possible value, we do not guarantee any specific sales price, timeframe, or outcome.

• Market conditions, buyer demand, property condition, and other factors beyond our control can affect results.

6. Client Responsibilities

• Sellers must maintain their property in a safe and marketable condition throughout the listing period.

• Sellers are responsible for providing accurate property disclosures as required by California law.

• All commitments will be confirmed in writing through a signed Listing Agreement.

7. Modification or Termination

• The Brasil Group reserves the right to modify or discontinue any program, including the 1.5% Listing Commission, Free Staging, or Renovate Now, Pay Later, at any time.

• Any changes will not affect clients under an active, signed Listing Agreement.

8. Legal Compliance

• All services are provided in compliance with the California Department of Real Estate (DRE) regulations.

9. Limitation of Liability

To the fullest extent permitted by law:

• The Brasil Group shall not be held liable for any indirect, incidental, or consequential damages arising from the use of our services.

• Liability for any claim shall not exceed the total commission paid under the applicable Listing Agreement.

10. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of California.
